Terms of Service

Welcome to SkinSync ("the Portal"). The Portal is owned and operated by Skin Alchemy HI ("we", "us", "our"). By accessing or using the Portal, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Description of Service
SkinSync provides a digital platform for skincare professionals ("Admins") to manage clients and employees, track client progress, assign home care routines, and centralize communication. Clients and Employees access the Portal to interact with their assigned Admin and view their skincare journey.
2. User Roles and Responsibilities
Admins (Business Owners or Account Holders)
You are solely responsible for all actions taken within your account, including the conduct of Employees and Clients you invite. You may resell access to the Portal to your Clients only, such as charging for virtual skincare tools, education, or client-facing services. You may not sell or charge Employees for access to the Portal under any circumstance. This rule exists to protect Employees from being required to pay for the Portal in order to be gainfully employed. You may share your admin login with Employees only if it is accessed from a single, shared device, such as a front desk computer or tablet. Sharing admin access across multiple personal devices is not permitted. To provide Employees with individual logins, you must purchase the Employee Management Add-On. You are responsible for the accuracy, legality, and content of any treatment plans, routines, or client data you upload. You must ensure your use of the Portal complies with all applicable local, state, and federal regulations. You agree not to share login credentials outside of your authorized team. You must inform Clients and Employees of their rights and limitations in using the Portal.
Clients (End Users Receiving Services)
Your access to the Portal is granted by your Admin. You are not permitted to share, resell, or redistribute the Portal or any of its features. You agree to use the Portal only for personal use as intended by your Admin. You must keep your login credentials secure and notify your Admin if you believe your account has been compromised. Skin Alchemy HI is not responsible for the quality, accuracy, or legality of services or advice provided by your Admin through the Portal.
Employees (Team Members Invited by Admins)
Your access is granted and managed by your Admin. You may not be charged for access to the Portal. If your Admin shares their login credentials with you, it must only be used from a shared device such as a front desk terminal. Personal or offsite access is not permitted unless your Admin has purchased the Employee Management Add-On and issued you a secure login. You agree to use the Portal solely for tasks assigned by your Admin and to maintain the confidentiality of client data. You may not resell, replicate, or distribute any part of the Portal or its contents. If your employment ends, your access to the Portal will be revoked immediately.
3. Fees and Payments
Admins are responsible for paying all subscription and add-on fees as outlined during account setup. All payments are nonrefundable, including but not limited to partial months of service, early cancellations, or unused features. Failure to pay fees on time may result in suspension or termination of your Portal access and permanent deletion of account data.
4. User-Generated Content
All data, images, notes, and content uploaded by Admins, Employees, or Clients remain the responsibility of the uploader. You must not upload any content that is false, misleading, offensive, illegal, or infringes upon the intellectual property rights of others. By uploading content, you grant Skin Alchemy HI a limited, non-exclusive license to use, host, and distribute it as needed to deliver the Portal’s features. We are not liable for any misuse or misinterpretation of information shared through the Portal by other users.
5. No Medical Liability
Skin Alchemy HI does not provide medical advice or services. Any skincare routines, treatment plans, or recommendations are created solely by your Admin and are not reviewed, approved, or endorsed by Skin Alchemy HI. Always consult a licensed medical provider for medical concerns.
6. Disclaimer of Warranties
The Portal is provided "as is" and "as available." We do not guarantee uninterrupted service, compatibility with all devices, or that the platform will be error-free. Use of the Portal is at your own risk.
7. Limitation of Liability
To the maximum extent allowed by law, Skin Alchemy HI is not liable for: Any damages caused by use or inability to use the Portal. Data loss, corruption, or unauthorized access. Disputes between Admins, Clients, or Employees. Any indirect, incidental, or consequential damages related to your use of the platform.
8. Indemnification
You agree to indemnify and hold harmless Skin Alchemy HI, its owners, employees, agents, and affiliates from any claim, demand, liability, loss, or expense arising from: Your use of the Portal. Any violation of these Terms. Any content you upload or manage through the platform. Any disputes between Admins, Clients, or Employees.
9. Termination
We reserve the right to suspend or terminate access to any account at our sole discretion without notice if you violate these Terms. Admins who cancel or fail to renew their subscriptions will lose access to their Portal, including all associated Client and Employee data, at the end of their billing cycle.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Honolulu, Hawaii, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
11. Modifications to Terms
We may update these Terms at any time. Any changes will be posted on this page with the updated effective date. Continued use of the Portal after changes are made constitutes your acceptance of the revised Terms.
